§ 25-61. Purpose and policy.

  • This article sets forth uniform requirements for direct and indirect contributors into the wastewater collection and treatment systems of the publicly owned treatment works within the city and enables the publicly owned treatment works to comply with all applicable state and federal laws required by the Clean Water Act , the Federal General Pretreatment Regulations (40 CFR 403), and the Virginia Permit Regulation (9 VAC 25-31-730 et seq.).

    The objectives of this article are:

    (a)

    To prevent the introduction of pollutants into wastewater systems which will interfere with the operation of the system or contaminate the resulting sludge;

    (b)

    To prevent the introduction of pollutants into wastewater systems that will pass through the system, inadequately treated, into receiving waters or the atmosphere or otherwise be incompatible with the system;

    (c)

    To protect both publicly owned treatment works personnel who may be affected by wastewater and sludge in the course of their employment and the general public;

    (d)

    To improve the opportunity to recycle and reclaim wastewaters and sludges from the system; and

    (e)

    To provide for fees for the equitable distribution of cost of operation, maintenance and improvement of the publicly owned treatment works.

    This article provides for the regulation of direct and indirect contributors to the wastewater system through the issuance of general permits to certain nondomestic users and through enforcement of general requirements for other users, authorizes monitoring, compliance and enforcement activities, establishes administrative review procedures, requires user reporting, assumes that existing customers' capacity will not be preempted, and provides for the setting of fees for equitable distribution of costs resulting from the program established herein.

    This article shall apply to the city and to persons outside the city who are, by contract or agreement with the city, users of a POTW. Except as otherwise provided herein, the superintendent of the POTW providing wastewater treatment service to a user shall administer, implement, and enforce the provisions of this article.
