§ 24-28.1. Reduction of speed limits in work areas and areas where roads are under construction or repair.

  • (a)

    The city manager is authorized to reduce, for a temporary period not to exceed sixty (60) days, without an engineering and traffic investigation, the maximum speed limit on any portion of any city highway (as that term is defined in section 46.2-100 of the Code of Virginia, as the same may be amended from time to time) on which work is being done or where the highway is under construction or repair (a "highway work zone").

    (b)

    When the city manager has set the maximum speed limit in a highway work zone pursuant to this section, and one (1) or more signs or markers have been placed in conformity with section 46.2-1300 of the Code of Virginia, as the same may be amended from time to time, and such signs or markers are not missing, substantially defaced, or obscured so that an ordinarily observant person under the same circumstances would not be aware of the existence of this section, it shall be unlawful for any person to operate any motor vehicle in excess of such maximum speed limit. Operation of a motor vehicle in excess of a maximum speed limit established pursuant to this section shall be unlawful and constitute a traffic infraction.

    (c)

    Notwithstanding anything to the contrary in the preceding subsection (b), when workers are present and when a highway work zone is indicated by appropriately placed signs displaying the maximum speed limit and the penalty for violations, operation of any motor vehicle in excess of a maximum speed limit established pursuant to this section shall be unlawful and constitute a traffic infraction punishable by a fine of not more than five hundred dollars ($500.00).

    (d)

    Nothing in this section shall preclude the prosecution or conviction for reckless driving of any motor vehicle operator whose operation of any motor vehicle in a highway work zone, apart from speed, demonstrates a reckless disregard for life, limb, or property.
